These General Terms and Conditions of Sale (GTC) apply to all contracts concluded between a consumer or a professional and the NG DYNAMIS brands (hereinafter referred to as the seller) concerning the products and/or services offered by the seller on its online store. These GTC supersede any conditions imposed by the customer, unless otherwise agreed.
n these Terms and Conditions, the term "customer" refers to both a consumer and a professional.
General terms and conditions of sale.
The product descriptions published on the seller's online store constitute binding offers from the seller. These offers can be accepted by the customer in accordance with the process described below.
The customer can place an order and thereby accept the seller's offer by telephone, mail, email, or via the order form integrated into the seller's online shop. When ordering via the online ordering module, the customer, after entering the personal information related to the order and clicking the button to complete the order, makes a binding declaration of acceptance of the offer relating to the goods contained in their shopping cart.
The seller sends the customer an acknowledgement of receipt (electronically) of the order that is transmitted to him.
The contract text is archived by the seller, and a copy is sent to the customer along with these Terms and Conditions. This transmission occurs at the time the order is placed, in text format (email). Furthermore, this document is also archived on the seller's website and can be requested free of charge by the customer through their password-protected account. To do so, however, the customer must have created an account on the seller's website before placing their order.
Before placing a firm and final order via the seller's online ordering module, the customer has the opportunity to correct the information entered. Furthermore, all the information provided will be displayed again in a confirmation window just before final order validation and can be corrected there in the same way.
Only the french language is valid for the conclusion of the contract.
Order processing and contact are handled via email and an automated order processing system. The customer is responsible for ensuring the accuracy of the email address provided for order processing purposes and to receive emails from the seller. Furthermore, if using spam filters, the customer must ensure that all emails sent by the seller or by third parties involved in order processing are received.
You have the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item.
To exercise your right of withdrawal, you must notify us (NG DYNAMIS, contact@ng-dynamis.com) of your decision to withdraw from this contract by means of an unambiguous statement.
o ensure that the withdrawal period is respected, you simply need to send your communication regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.
Unless otherwise stated in the product descriptions published by the seller, the prices indicated by the seller are final prices in euros, inclusive of all taxes (VAT). Additional delivery and shipping charges may apply. These will be expressly indicated in the order confirmation form, if applicable.
Deliveries to countries outside the European Union may incur additional costs borne by the customer and not attributable to the seller. These include, for example, fees related to money transfers made by credit institutions (transfer fees, exchange fees) and import duties or taxes (customs duties). Such costs may also be incurred in the context of a money transfer if the delivery takes place in a country belonging to the European Union, but the customer makes the payment from a country outside the European Union.
The customer can choose between the different payment methods displayed on the seller's website.
If an advance payment is agreed upon, it must be made immediately after the conclusion of the contract.
Goods are usually delivered by mail to the address provided by the customer, unless otherwise agreed. The delivery address shown on the order processed and managed by the seller is the one used for the execution of the transaction.
If the shipping company returns the goods to the seller because delivery to the customer was impossible, the customer will be responsible for the costs incurred due to the failed delivery. However, this will not apply if the customer has correctly exercised their right of withdrawal, if the customer is not responsible for the circumstances that made delivery impossible, or if they were temporarily prevented from receiving the delivery, unless the seller had previously informed them of a reasonable delivery timeframe.

At NG DYNAMIS, we are committed to providing you with fast and hassle-free delivery. We do our best to make the delivery of your products as simple as possible.
France
Delivery to France is handled in two different ways depending on product availability. We consider a product available as soon as it is stocked by the supplier. However, suppliers also store products in Germany or Italy, resulting in two scenarios. It should be noted that in the vast majority of cases, the product is shipped from France.
Product available in France : Delivery via Colissimo (Except bars, large volumes and items over 30 kg) or France Express depending on the supplier.
Product available in Germany or Italy: Colissimo with transit to NG DYNAMIS premises. 2 to 4 additional working days.
Other destinations
For countries outside France, your order will be processed at our facilities so that we can ship the goods to your desired location. Once we receive the goods, your order will be shipped via Colissimo.
Large volumes
Colissimo does not handle bulky packages, therefore we reserve the right to refuse an order when we are unable to deliver the product.
Return shipping costs are the responsibility of the customer. Regarding the returned product, it will be refunded or exchanged according to your request and available stock. If a refund is due, it will be processed within one month of receiving your return.
All purchases made from NG DYNAMIS brands are governed by French law. All disputes arising from purchase, sale, and rental transactions concluded under these Terms and Conditions, concerning their validity, interpretation, performance, termination, consequences, and subsequent effects :
They will first be subject to an attempt at amicable resolution.
In the event of failure of initial amicable discussions, an attempt at resolution via conventional mediation may be made.
All legal relations between the contracting parties are governed by the law of the country where the seller has its registered office, excluding the United Nations Convention on Contracts for the International Sale of Goods. The exclusive jurisdiction for any dispute relating to this contract is that of the seller's registered office.

In order to resolve disputes with a seller, consumers have the option of resorting to mediation through this European platform.
In accordance with the provisions of the Consumer Code, an amicable settlement also applies to cross-border consumer disputes. If the customer wishes to use such a mediation service, they can consult the website of the Consumer Mediation Evaluation and Control Commission (http://www.economie.gouv.fr/mediation-conso/commission).
